GENERAL CONDITIONS OF TRANSPORT OF PASSEGNERS


1 - DEFINITIONS

1.1. By Passenger we mean each person transported with a ticket for passage sold by the Carrier. Carrier and/or Company will be understood as CARONTE & TOURIST S.p.A.
1.2. The Carrier is to transport the passenger and (l) passenter vehicle (o) under the following conditions, that the passenger, for the single reason of having made a reservation and/or bought a ticket for passage, declares, implicitly, to have full knowledge of and to agree to follow the rules in their entirety.

2 - VALIDITY
2.1. The ticket for passage is personal and non-transferable, valid exclusively for the transport indicated in it and must be kept by the passenger and shown, upon request, to any officer of the ship or member of the company.
2.2. Passengers without tickets must immediately inform the ship's commander and/or the commissioner on board.

3 - TICKET PRICES
3.1.The price indicated on the ticket is fare requested by the Carrier, valid only on the date of sale and does not include food on board, which remains the sole responsibility of the passenger.
3.2.The responsiblities of the passenger also include the costs, embarkation and disembarkation taxes and fees.

4 - FAILURE TO DEPART
4.1. The embarkation schedule, if it has not been modified in writing, is to be carried out two hours before the scheduled departure time of the ship for passenger with vehilces; for passengers without vehicles, it is an hour; failure to board within that time will result in the loss of the same reservation.
4.2.Passengers who are not present within the time indicated for boarding or who do not board the shipwithin the time indicated on the ticket have no right to full nor partial reimbursement of the ticket price.

5 - FAILURE TO DEPART
5.1. Le prenotazioni sono effettuabili attraverso le seguenti modalità:
a) by telephone at the following number: 0905726504;
b)on the internet, at the site: www.carontetourist.it;
c)through a selected travel agency.
5.2. Telephone and agency reservations must be confirmed through payment within 72 hours  or they will not be valid.

6 - VARIATION, WITHDRAWAL and REIMBURSEMENT
6.1. In case of variations or withdrawal made within 24 hours after the confirmation of the reservation, as long as it is before 24 hours prior to departure, no penalty is due.
6.2. In case of variations of reservations, which is not possible Saturdays, Sundays, or Holidays, if the conditions of the previous point are met and are not made within 24 hours of the departure time, a penalty of 10% shall be paid, to be calculated on the price of the ticket of the selected route.
6.3.. If there has been a reduction of the price of the passenger ticket, the penalty shall be calculated on the difference in the price of the ticket according to the preceding point.
6.4. In case of withdrawal done within 24 hours after the reservation confirmation and not within 24 hours prior to departure, no penalty is due.
6.5. In case of withdrawal of the reservation, which cannot be done on Saturdays, Sundays, and Holidays, the following penalties will be applied, to be calculated on the basis of the total price of the passenger ticket for the route selected:
a) 10% (ten percent), from within 24 hours after confirmation and up to 20 days preceding the date of departure;
b) 20% (twenty percent), from nineteen (19) days to four (4) days preceding the date of departure;
c) 50% (fifty percent), from three (3) days to 24 hours before the scheduled departure time;
d) 100% (one hundred percent), for anything outside the preceding hypotheses and in case of a no – show.
6.6. Variations or withdrawal can be taken care of at the call center, by fax or e-mail.
6.7. The calculation of terms starts from the day following the date of withdrawal or vationa and includes the day of the scheduled departure.

7 - EARLY, LATE DEPARTURE OR ARRIVAL, CANCELLATION OF DEPARTURE OR MODIFICATION OF ITINERARY
7.1. Before departure, the passenger must verify whether or not some variations have been made regarding the ferry or the departure time indicated on the ticket.
7.2. The company can cancel scheduled departures, add or omit scheduled stops, change scheduled ports of departure, change ships for any specific route, and anticipate or delay the date of departure.
7.3. If the departure is delayed by more than 12 hours from the scheduled departure time, the passenger has the right to reimbursement of the price of the unused ticket.
7.4.The commander has full authority to proceed on autopilot, to tow and assist other ships for any reason, to stop in any port more or less near the scheduled route of the ship,both before and after departure even if the direction is reversed or is beyond the usual route of the ship in any order and for any reason, one or more times, to transfer the passengers and the vehicles onto any other ship or means of transportation whether or not it belongs to the same company, directly to the destination.
7.5. The arrival time, if specified on the ticket, or otherwise communicated by the company or its affiliates, is purely indicative and the Carrier is not responsible for eventual delays.

8 - EMBARKING AND DISEMBARKING VEHICLES
8.1. Vehicles will be called to embark in the order imposed by the commander of the ship and/or his appointees or assistants.
8.2. The operations of embarking the vehicles, including the positioning in the assigned space on board and the eventual transferral of the vehicle to its parking place, are always to be done carefully, at the risk and responsibility of the passenger.
8.3. Passengers are furthermore, exclusively responsible for eventual damages to their own vehicles, articles and baggage contained in it, to themselves, as well as the other people in the vehicles.
8.4. Passengers are also exclusively responsible for eventual damage caused by third parties, their vehicles, articles and baggage.
8.5. Vehicles, including anything towed and/or campers, with everything they contain, will be accepted by the Carrier as a single unit without a declaration of value: therefore, the responsiblity of the Carrier for the loss and/or damage to the vehicle cannot exceed the limit according to art.423 of the Navigation Code.

9 - RULES TO BE OBSERVED BY THE PASSENGER
9.1. Passengers must observed Italian and international laws, as well as the regulations of the company and the orders given by the commander of the ship.
9.2. Passengers, moreover, respond directly to the company for all contraventions, molestations, fines and expenses for which, on their part, the company is subject to the Port, Customs, Health Authorities and/or any other Authorities of any country.
9.3. It also remains as agreed that minors must be under the surveillance of the parents or guardians and cannot wander throughout the ship unaccompanied.
9.4. In case of emergencies, the passengers must be available to the commander and officials and must follow orders and instructions in a discipline manner.

10 - HEALTH CONDITIONS OF THE PASSENGER
10.1. The commander has the authority to refuse passage to anyone who is in not in the physical or psychological conditions to face the journey or to anyone who may be dangerous because under the influence of drugs, hallucinogens, or alcohol; or because of sickness or infirmity.
10.2. In such cases, passengers do not have the right to reimbursement or to payment of damages and are solely responsible for damage inflicted on the ship, its equipment, third parties, or their property. Acceptance of the passenger on board by the company is not considered as a renouncement of the company to express reserve regarding the conditions of the passenger, whether they are known, knowable (or not) by the company, at the time of embarkation and/or departure of the ship.

11 - ESPLOSIVES, INFLAMMABLES AND DANGEROUS MATERIALS
11.1. It is severely prohibited for the passengers to include in their baggage or in their property within their vehicles materials such as industrial residue, explosive substances and/or inflammable or otherwise dangerous substances  for the security of the ship, its load and the safety of the other passenger passengers or members of the crew.
11.2. In the case of violation of this rule, the commander is authorized to sequester or destroy these substances, while the passenger has no right to indemnity.
11.3. Passengers, moreover, are responsible for the consequences of the violation of this rule.

12 - ARMS
12.1. Upon boarding the ship the passenger has the obligation to give any weapons and or firearms in his possession to the commander.
12.2. If the passenger fails to turn in such weapons, the offending passengers and deferment to the competent Judicial Authority.

13 - ANIMALS
13.1. The transport of small domestic animals (cats, dogs, etc.) by the passenger is allowed as long as the animal is accompanied by a certificate of good health and is assigned a ticket.
13.2. In conformity with hygienic-health regulations, domestic animals, when they have been accepted by the company, must travel in the areas assigned, and it is absolutely prohibited to  keep them in the cabins or in the social areas.
13.3. Passengers are responsible for any eventual damage caused by their animals to things or third parties.
13.4. The Carrier declines any responsibility for the sequestering or suppression of the animal on the part of Health Authorities of the part of entry, nor for injuries, loss or death of the animal during transport, boarding or deboarding.

14 - SEATING
14.1. The passenger must occupy the seat indicated on the ticket, or, if the ticket is lost, the one assigned by the commander or the ship commissioner.
14.2. The company has the authority to assign any passenger a different seat from the one indicated on the ticket: if the seat assigned is from a superior class, no difference will be made on the price of the ticket, while if the new seat is in a lower class, a reimbursement of the difference between the two tickets will be paid to the passenger, in which case the the passenger renounces any further actions.

15 - APPLICABLE LAWS AND  E COMPETENT  'FORO COMPETENTE'
15.1. The transportation contract is regulated and interpreted according to Italian law.
15.2. For any controversy relative to the interpretation and/or execution of the transporation  shall be exclusively placed within the competence of the Messina Courts.
